The Equal Employment Opportunity Commission (EEOC) has recently released new guidance regarding rights of employees with mental health conditions.

 Many American workers suffer from mental health conditions such as anxiety, depression, or PTSD. Frequently, employers aren’t even aware of a condition. However, should an employer become aware of a mental health condition, the Americans with Disabilities Act (ADA) will often apply.

 In general, mental health conditions are treated the same as any other disability under the ADA. Additional protections may apply in some circumstances and employers should always proceed with caution whenever they seek to discipline or terminate an employee where the behavior could be related to a mental health condition or other disability.
