DOL Overtime Rule Delayed
On November 22, 2016 a U.S. District Court Judge in Texas granted an Emergency Motion Injunction which prohibited the Department of Labor (DOL) from moving forward with the new proposed overtime rule. The Department of Justice filed a motoin to appeal on behalf of the DOL. The law is currently being litigated and the future of the law will only be known after litigation runs it course. As it stands the December 1, 2016 deadline will pass and the existing law will remain in effect until further notice.
Update:
On August 31, 2017 the same U.S. District Court ruled that the DOL over stepped it’s authority and prohibited the DOL from implementing the new law. The courts final rule was that the salary exceeded the DOL’s authority and concluded the final rule is invalid.
